Rent Increase Notice Template

A rent increase notice is a formal written letter from a landlord to a tenant informing them that the monthly rent will be raised to a new amount starting on a specified date. This document is not just a courtesy but a legal requirement in virtually every state and municipality. Landlords must provide adequate advance notice, typically 30 to 60 days before the increase takes effect, though some jurisdictions mandate longer notice periods for larger increases. In areas with rent control or rent stabilization ordinances, there may be caps on how much rent can be raised annually, and specific procedures must be followed.

Landlords raise rent for a variety of legitimate reasons, including rising property taxes, increased insurance premiums, higher maintenance and repair costs, improvements made to the property, and broader market adjustments to keep the rent in line with comparable properties in the area. Regardless of the reason, delivering a properly formatted written notice protects the landlord legally and gives the tenant sufficient time to decide whether to accept the new rate, negotiate, or begin searching for alternative housing. A rent increase cannot typically be imposed in the middle of a fixed-term lease unless the lease contains a specific clause permitting it; most increases take effect upon lease renewal or during month-to-month tenancies.

An effective rent increase notice should clearly state the tenant's name and the property address, the current rent amount and the new rent amount, the date the increase will take effect, the legal or contractual basis for the increase, and any instructions for the tenant if they wish to accept or decline the new terms. The notice should be professional and straightforward in tone. Serving the notice via certified mail or personal delivery with a signed acknowledgment ensures there is documentation that the tenant received it. Landlords should retain a copy for their records and verify that the notice complies with all applicable local and state notice period requirements before sending it.
