Lease Termination Notice Template

A lease termination notice is a written document that formally communicates one party's intention to end a rental agreement. It can be issued by either a landlord or a tenant and serves as the legally required notification that the tenancy will not continue past a specified date. Proper termination notices are essential because most jurisdictions require written notice delivered within a defined timeframe, and failing to follow these requirements can expose you to penalties, continued rent obligations, or difficulty recovering your security deposit.

There are several situations that call for a lease termination notice. Tenants may need to end a lease early due to job relocation, health issues, military deployment under the Servicemembers Civil Relief Act, or uninhabitable living conditions that the landlord has failed to remedy. Landlords may issue termination notices when a lease term is expiring and they do not wish to renew, when a tenant has violated lease terms, or when the property is being taken off the rental market for sale or renovation. In month-to-month arrangements, either party can typically terminate with 30 days' written notice, though some states require 60 days or more.

Your lease termination notice should include the full names of the landlord and tenant, the rental property address, the date the notice is being sent, the specific date the tenancy will end, a reference to the lease clause or statutory provision authorizing the termination, instructions for returning keys and completing a move-out inspection, details about how the security deposit will be handled, and a forwarding address for the departing tenant. Sending the notice via certified mail or another delivery method that provides proof of receipt is strongly recommended. Keep a copy of the notice along with delivery confirmation in case a dispute arises later.
